    The claim is regarding the work of instore staff being valued and paid less than the work of distribution centre staff. Although the two roles are different, equal pay experts have judged them to be of equal value.

    This means that Next instore staff are now able to join the Next Equal Pay Claim, to gain back up to six years worth of backpay- which could amount to over £10,000.

    An Equal Pay Claim for work of equal value means that the work that Next instore staff do, although different from that being done by the Distribution Centre staff, is of equal value in terms of the demands made on them.

    Although the jobs may be different, the jobs can be regarded as being of equal worth, when taking into account: the nature of the work performed, the training or skills necessary to do the job, conditions of work and the decision-making that is part of the role.

  • q-iconHow do you determine whether there is unequal pay?

    For the purposes of the Equality Act 2010, the concept of pay includes wages as well as other terms and conditions- e.g. bonus payments, holidays and sick leave.

    This means that there may still be a breach of equal pay, even when two employees receive the same basic rate of pay, but other benefits e.g. holidays, bonus payments are not provided on an equal basis.

    The Equality Act applies to any difference in pay or benefits provided by the contract of employment.
