PAY JUSTICE EXCLUSIVITY AGREEMENT

This agreement relates to the relationship known as Pay Justice Limited the claims management company and Claimant, this shall be deemed to include any interest deriving its value from any claim and to the proposed claim the claimant puts forward to Pay Justice Limited.

IT IS AGREED AS FOLLOWS:

  1. Exclusivity period

This agreement begins on the date when you click on the box on the online tool on Pay Justice Limited’s website and continues to completion of your claim and settlement of your claim in full.

2. Claimants Obligations

2.1 In consideration of Pay Justice Limited, undertakings given in and expenses incurred in connection with this agreement, and until this agreement expires, the Claimant shall not:

2.1.1  Sign up to any other solicitor without Pay Justice Limited's prior approval in connection with this claim and any proposed claim to anyone other than to the Pay Justice Limited approved solicitors;

2.1.2 Conduct any discussions or enter into any commitment with any solicitor in connection with this or any proposed claim;

2.1.3 Permit any person other than the Pay Justice Limited (or person acting on Pay Justice Limited's behalf) to view or obtain details of the claim.

3. Pay Justice Limited Obligations 

3.1 In consideration of the claimant undertaking to comply with Pay Justice Limited obligations in this agreement, and until this agreement expires, Pay Justice Limited shall promptly:

3.1.1 Instruct Pay Justice Limited approved solicitor to deal with the claimants' claim;

3.1.2 Immediately instruct its approved solicitors to promptly

(a) send the details of the claim to Pay Justice approved solicitors appointed by Pay Justice Limited;

(b) deal with the claim with Pay Justice appointed solicitors and if necessary, update the claimant with the proposed amendments or additions to the claim and;

(c) provide answers to enquiries;

3.1.3 Promptly provide its solicitors with all documents and information reasonably necessary to ensure solicitors to provide answers to the claimants' enquiries.

4. Duration of this Agreement 

4.1 This agreement will last the duration of the claimant's claim.

4.2 On expiry of this agreement, both parties will then be released from any further obligations but without prejudice to any antecedent breach of either part of its obligations in this agreement.

5. Miscellaneous 

5.1 The terms of this agreement may only be amended or modified by written agreement between Pay Justice Limited and the Claimant.

5.2 This agreement does not give rise to any rights under the Contracts (Rights of Third Parties Act 1999) to enforce any term of this agreement.

5.3 This agreement is personal to the parties and neither party shall assign, transfer, charge or deal in any other manner with this agreement or any of its rights under it, not purport to do any of the same.

5.4 This agreement and any dispute or claim arising out of or in connection with it or its subjects matter or formation (including non-contractual disputes or claims are governed by the law of England.

5.5 Pay Justice Limited and the Claimant irrevocably agree that the courts of England have exclusive jurisdiction to determine any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

This agreement has been entered into on the date stated at the beginning of it.
